【求教】:买房1年后收到tax lawyer的信说stamp duty可以部分减免,这事靠谱么?

买房1年了,最近收到这家律师的来信,说是stamp duty可以claim回来2/3,原因是房子有加建granny annex,可以multi dwelling relief. 律师费是拿回来sdlt减免回来费用的20%。

大家有碰到过类似的情形么?不知道这样靠谱不。Sounds too good to be true. 请各位大牛指教,谢谢先。

我也不懂。但是上网搜了一下,确实你律师说得对吧。我也涨知识了。以前我也见过个带annex的房子挺喜欢呢,不知道还有这回事。
关于SDLT relief for multiple dwellings:

Example
You buy 5 houses for £1 million.
£1 million divided by 5 is £200,000.
The amount of SDLT you pay on £200,000 is £1,500 (0% of £125,000 + 2% of £75,000).
£1,500 multiplied by 5 is £7,500.
But that’s less than 1% of £1 million, which is £10,000. The amount of tax you pay is £10,000.

然后granny annex好像是算multiple dwellings 的。看这里的例子:

So while the purchase of a £1.5m property would attract SDLT of £93,750 under the new rules (£75,000 under the old), if the property is found to have an annex the multiple dwellings principle can be applied reducing the SDLT to £55,000.

你自己可以算一下。把房价除以二。当每部分房价。算一个部分的stamp duty。然后乘以2. 这貌似是你应该付的stamp duty。肯定会比整体算要沾光。

如果是multiple dwellings,那以后是不是需要付multiple council tax啊?

应该是,这样counciln tax会贵很多,如果出租的话还行,不然还不如多交点stamp duty少交council tax好。如果不像被视为seperate dwelling,最好的办法就是把厨房拆掉。

这信看着不合理啊,如果楼主是通过这个律师买的房子,为什么律师不知道你的名字呢? 信件开头连个名字都没有,就一个Dear… 和诈骗信件一个类型嘛:o
