关于房屋出租夫妻之间收入转让的问题

我准备近一两年在家带孩子,而且我老公的税率比我高,想把出租房的收益改成我拥有99%他1%。我们知道要填一个form17的表格,同时要提供一份beneficial interests are unequal的deed。同时有几个问题不确定,请有经验的朋友分享一下。

1.我们只是在房屋收益上改动,在法律上对房屋的拥有权上我们还是平分的,这一点hmrc不会有异议吧?
2.房屋还有贷款,之后如果remortgage会有问题吗?
3.是否不用通知land registry我们有这样的改动,因为拥有权我们还是平分。
4.转给我的shares用交stamp duty吗?
5.除了以上的form 17和deed还需要什么文件。

不改所有权比例就改收益分配是不行滴

如果是婚前房,结婚后这个比例是默认对方占一半吗?还是没份的?

没有money change hand就没有stamp duty。

简单的说没有mortgage可以零价格转让没有stamp duty,如果有mortgage,那就是得一个人借mortgage还另外一个人的mortgage,有money change hand就有stamp duty。唯一的例外是如果转房子是divorce settlement的一部分那不管有没有money change hand都没有stamp duty。

Stamp duty does not necessarily apply to transaction below the SDLT threshold, which is 125k at the moment.

For example, if lz’s house has an outstanding mortgage of 250k, taken by them two equally. Her husband may transfer most of his mortgage, which is nearly 125k, with the permission from the mortgage provider, to LZ without occurring any stamp duty. Depends on the size of the mortgage and the way you make the transfer (gift or cash).

不是说离婚官司,是说婚前房产出租房屋的话报税怎么报啊,是两个人都要填,各占一半。还是婚前房名字的那个人报就行了?

除非你把房子转成两个人的名字,不然谁的名字下谁报。
