认识的一个马来朋友，也是签证过期，之后在这边结婚生孩子，又拿福利，她老公是永居，孩子出生入籍后，她开始试着通过律师申请签证，前后试了两种申请了两年（因为第一种申请递了之后就遥遥无期了，于是撤销了）第二次申请等的时间短一些，上个月刚刚批了下来，给了两年半的有效期。

LZ要申请的话，除了等没有其他办法了，有个朋友和你情况类似，申请应该已经递交了18个月以上了，小孩已经一岁半了，现在还是在等。

你的签证过期多久了？因为可以解释为什么过期，原因是什么，比如说由于你生孩子无法回国，HO会考虑这些因素的。

可以申请dlr,现在都是给两年半，以前都是给三年的并且福利无限制，并且是续签一次可以拿永居的。

去年七月政策开始变了，现在是续四次签满10年才申请永居，走10 years family route，中间不能断，断了的话要重新开始算。表格是FLR（o），这种签证现在是no recourse to public fund。而且可能要处理很久, 不过你老公孩子是英籍一般申请没问题都能下来，因为符合exceptions。

万一被拒，现在一般都会给appeal权利，不管你以前是不是合法身份。过去的话一般申请的时候非法身份是不给appeal rights的

EX.1. This paragraph applies if

(a) (i) the applicant has a genuine and subsisting parental relationship with a child who-

(aa) is under the age of 18 years, or was under the age of 18 years when the applicant was first granted leave on the basis that this paragraph applied;
(bb) is in the UK;
(cc) is a British Citizen or has lived in the UK continuously for at least the 7 years immediately preceding the date of application ;and

(ii) it would not be reasonable to expect the child to leave the UK; or

(b) the applicant has a genuine and subsisting relationship with a partner who is in the UK and is a British Citizen, settled in the UK or in the UK with refugee leave or humanitarian protection, and there are insurmountable obstacles to family life with that partner continuing outside the UK.
