我也很希望是四年spent，但是DVLA说的是指驾照上扣的分会在4年后spent，并非指5年的 rehabilitation periods，尤其与此同时有法庭Fine的话， rehabilitation periods需要5年。

你说得对，FNP是不算在内的，小数额的法庭Fine，如果不是伴随某几种罪名，也许也不算在内。但是没有保险开车的情况不在少数，这类行为不能豁免。希望大家好运吧！

我的情况是5月就够资格申请10年了，可是我在2008年的时候也是没有保险被抓，结果是上法庭，被判禁驾一年并 …

然后12月3号收到法庭信，是信，不是传票。。就说我驾照被吊销6个月。。没有上庭，也不知道有没有罚款{:5_139:} 。。估计之前给我发信让我上庭了，应该是搬家的原因没有收到。。。。

现在也不知道怎么查我到底欠不欠法庭的FINE。。。

Certain convictions are deemed “spent” under the Rehabilitation of Offenders Act 1974 after the following periods of time (known as the “rehabilitation period” – the period is halved where the offender was under 18 at the point they were convicted)

  • Imprisonment: 2½ years or more – Never
  • Preventative detention – Never
  • Detention for life at Her Majesties Pleasure - Never
  • Imprisonment: less than 2½ years but more than 6 months – 10 years
  • Imprisonment: less than 6 months – 7 years
  • Fines – 5 years
  • Armed Forces: dismissal with disgrace – 10 years
  • Armed Forces: dismissal – 7 years
  • Armed Forces: detention re conviction – 5 years
  • Borstal – 7 years
  • Detention: less than 2½ years but more than 6 months – 5 years
  • Detention: less than 6 months – 3 years
  • Probation – 5 years
  • Mental Health Act Hospital Order – 2 years post cessation of order or 5 years, whichever is the longer
  • Absolute discharge – 6 months
  • Conditional discharge – 1 year post conviction or 1 year post cessation of order, whichever is the longer
  • Probation order - 1 year post conviction or 1 year post cessation of order, whichever is the longer
  • Binding over - 1 year post conviction or 1 year post cessation of order, whichever is the longer
  • Care order - 1 year post conviction or 1 year post cessation of order, whichever is the longer
  • Supervision order - 1 year post conviction or 1 year post cessation of order, whichever is the longer
  • Disqualification – the period of disqualification

FPN is not fine, but Driving without insurance is a serious offence result in an immediate disqualification from driving and also being fined so LZ does fall into category Disqualification- the period of disqualification(6 months) and also Fine- 5 years instead of 4 years that means write off from ur license .

入籍会受影响，但不同的是申请入籍的人基本上都是有PR的，所以大不了在等多几年，他们还是可以留在英国。现在的new rule会让很多人不得不离开英国。

只要是fine 无论数额大小都应该是5年。fnp 因为从法源上就明确不是fine。

那就是说我的那种被吊销半年，但没有罚款的。。。也属于5年的…对吗。。。

你要确定你有无fine, e.g 你有几个endorsable fnps又交钱又被扣满12分／6分而禁驾6月，但你6个月就spent，只是你是无保险被禁驾，可能还有fine，希望你好运啦。

DVLA这么给解释的

A driver who accumulates 12 penalty points on his or her driving licence within a 3 year period, faces disqualification for a minimum of 6 months (Section 35 of the Road Traffic Offenders Act 1988). These are referred to as the “Totting Up” provisions

借问一下，我去年2月份有一次speeding，限40开了52被拍了，扣3分，好象是罚60镑，这个也是要5年才能清吗？还是3年？

就是我搬到新家之后不久，收到一封Magistrates’ Court 信。。说我驾照从12月3号开始吊销6个月。。。没有提任何罚款什么的。。。
当初我也不知道怎么联系。。或是问他们。。。。。

现在想问，可是不知道问谁了{:5_133:}
