From Monday 2 April 2007 anyone applying to permanently settle in the UK will need to provide evidence of Knowledge of the English Language and of Life in the UK (as those applying for British Citizenship are already obliged to do).
The new requirement is being introduced to encourage people to learn English and to find out about our structures, laws, democratic processes and traditions. Introducing these arrangements at settlement stage will ensure that migrants take part in society and become full and active citizens earlier, enabling them to fully integrate into society.
There are two ways an applicant can demonstrate knowledge of life in the United Kingdom as well as language ability:
• If the applicant is already at or above ESOL (English for Speakers of other languages) Entry 3 standard of English, they will be able to undertake a specially developed short test called "Life in the UK Test"Life in the UK Test.
OR
• If the applicant has not reached ESOL Entry 3 they need to gain an approved English for Speakers of Other Languages (ESOL) qualification, through attending an ESOL course which includes citizenship materials.
Applicants who are unsure of their language ability should work through the navigation tutorial navigation tutorial on the “Life in the UK Test” website. If they are unable to fully understand the information, then they may need to enrol on an ESOL with citizenship course.
Testing will start on 2 April 2007.
New test questions have been developed based on the second edition of the handbook “Life in the United Kingdom: A Journey to Citizenship”, which is available from the Stationery Office and good bookshops.
However for the period 2 April through to 30 June 2007 applicants will be able to take the test based on either the first or second editions of the handbook. The applicant simply needs to tell the test centre which test they wish to take.
After 30 June 2007, tests will be solely based on the second edition. The new edition includes a new chapter on opportunities to serve in public life.
IND’s experience in the past is that someone applying for settlement after 2 April 2007 may forget or omit to include evidence of meeting the new requirements. To ensure people are not left without leave, incomplete applications for settlement will automatically be treated as one for further leave to remain until 31 January 2008.
Because of the price increase for settlement applications, it has been decided that any difference between the settlement fee and the further leave to remain fee will be returned to the applicant once a final decision has been reached. This will be applicable until 21 May 2007.
Work Permit holders applying for settlement who cannot provide evidence that they meet the requirements will need to ensure their employer makes an application for a new work permit.
Without this their application will be refused.
People who meet these new requirements at the settlement stage will not be required to take another test or course in order to qualify for citizenship, provided they meet all the other requirements.
