大家好， 本人SOLE REP ( 首席代表签证 ） ,到 2014年3月份满5年，可以申请PR 了。 2013年6月有个酒驾记录（没有任何事故） ，上过法庭， 禁驾9个月， 2014年3月份就可以开车了 。 我这个CASE 肯定是有 CRIMINAL RECORD 了。 请有同样经历的朋友们， 帮忙指导一下， 申请PR 是否会有问题 ， 谢谢 。
you can apply ilr after 6/2015 as the New criminality threshold require applicant has no criminal records for last 2 years from the date of ilr application.
my solictor told me that I can apply . should be no problem . he said all the cases he processed . there are no one being refused visa due the the traffic offense .
also my sole Rep visa will expired by the end of March . if we do not apply for the ILR , can we keep renewing the SOLE REP ?
没有入狱轻微罪行在3年后可以申请，但是，酒驾，涉及信用的犯罪另外有说法的。2017年3月后找个律师申请吧。
Will you declare that offence for ilr if you don’t and case worker find out then you will face very seriously ground of refusal by deception. If you do then case work may or may not grant your ilr it all depends. AS FAR AS I KNOW THERE IS ONLY ONE OR TWO PEOPLE HAS BEEN GRANTED ILR WITH LIGHT OFFENCE. AS THE RULE SAYS YOU NEED TO BE CLEAN FOR LAST TWO YEARS HOWEVER YOU CAN HAVE A TRY THEN.
You can apply PNC and CRB report then check them see if any records on them if have records then most likely ilr will reject as case worker do checks base on those reports.

Traffic offence like FNP can be discarded, but anything goes to court must be declared, this is like 50/50 chance depends on the mood of caseworker.
Drink driving is quite serious though, not simple “traffic offence”, if the solicitor choose to hide it in your application, change another one
however if you failed he will make more money from “helping” you to appeal

If refused then right of appeal should be given you can choose appeal or make a freash application for renew your current visa but make sure the visa you hold is renewable or not. if right of appeal not given you have to leave the country.

我查的资料是如果被禁驾，申请永居的时候如果你申报了，就会被拒，是必拒，除非在2年之后，酒驾属于另外签证官考虑的一个因素，但是如果2年后，一般不属于必拒因素。
