HO官网上举例的GDL法律课程是不在学生签5年限制里的吗？

我现在在英国念了本科3年（NQF level 6），acca2年（NQF level 7），签证今年10月到期。到期前想续签GDL这个法律课程。目前有2个疑问：

  1. HO网站列举了特殊课程像law conversion course（GDL）是可以不算在5年内的，所以我虽然已经在degree+acca课程读了5年但是还是可以申请GDL这样的课程对吗？
    .In addition to the 3 years of permitted study below degree level as a Tier 4 (General) student
    and any time spent in the Tier 4 (Child) category, the time that you can spend studying at
    or above degree level will be limited to 5 years. However the following courses are exempt
    from the 5 year study limit and will not be included when the amount of time you have spent
    studying at or above degree level is calculated， regardless of when they were studied:
    • where you are studying a course at or above degree level in one of the following
    subject areas:
    • Architecture;
    • Medicine;
    • Dentistry;
    • Law, where the applicant has completed a course at degree level in the UK and is
    progressing to:
    • a law conversion course validated by the Joint Academic Stage Board;
    • the Legal Practice Course; or
    • the Bar Professional Training Course.
    • Veterinary Medicine & Science; or
    • Music at a music college that is a member of Conservatoires UK (CUK).

  2. GDL是等同于本科的也就是NQF level 6,但我现在已经读到了NQF level 7还能读回6吗？虽然是完全不一样的专业，academic proegress能不能说的通？如果学校认同了我并给了CAS, HO还会拒签吗？

这需要看你的degree是否能被Joint Academic Stage Board承认和允许进修CPE/GDL课程，如果是LLB那没问题，一些大学的BA in law也行。

我要申请的这个学校的GDL课程已经被Joint Academic Stage Board承认了，所以我想5年的限制应该不是问题。就是考虑到我这样越学Level越低不是和HO的政策不符嘛，学校倒是说给CAS没问题。

机构的CPE/GDL当然都是被承认的啊，但关键是要看你之前的degree是不是符合条件，你看一看ukba的原话：Law, where the applicant has completed a course at degree level in the UK and is progressing to，意思就是如果一个完成了的degree课程的下一步是下列某某某项，才不受此限制。

一般来说只有qualifying law degrees才符合规定的，但如果你只是普通的degree，毕业之后是自己打算另学一个转换到法律资格课程是不符合条件的。

学这个lz 一定要考虑好， 是不是真的有机会留在英国， 或者还想继续lpc/ bbr 课程， 要不回国的话法律真的是太不一样啦。 你要想好以后签证的事，这个太难啦，如果full time 的话，一年要过8科的，如果万一没有过，你以后的签证怎么办？ 这都要考虑的。

我好像以前看过home office 的guideline ，法律课程是不再限制之内的。 好像还有医学之类的。

这个其实是UKBA混乱的地方。如果是有qualifying law degree的话，是不需要读CPE/GDL课程的，而直接就读LPC，这是一个postgraduate 的课程，相当于level 7。CPE/GDL本身就是为没有qualifying law degree但是想在英国进入法律职业体系的人设计的。但是这样一来，很难解决academic progression的问题，因为要降级去读一个低级别的课程。我认为因人而异，如果申请人本身有一定的法律方面的背景，但是没有qualifying law degree，现在修GDL想要在英国法律职业发展，学校应该是可以justify的。如果背景完全没有相关性，会使签证官觉得很突兀。我认为被拒签的风险还是不小。
