我硕士毕业之后申请过一年的SEGS,到期之后回国办理了Phd的学生签证，现在phD毕业了，还能在申请PSW吗？我看他们网站说，除非我现在拿的是SEGS，才能再补一年的PSW，中间如果有隔断的话好像不行。我应该怎么办？谢谢了

貌似不行了吧。LZ当年申请的是英格兰理科毕业生当时可以申请1年的签证允许找工作的那个吗？和当年苏格兰的毕业后申请的两年签证是一样的，这些东西后来就都合并为PSW了。

可以肯定地告诉你：不可以。
SEGS和PSW是同类型的签证，如果申请过其中任何一个，则不能再申请另外一个。
但是，SEGS在没有到期之前，可以延一年成为两年。
可以拿到一年。我跟你的case很像，之前也有人说不能再申请，不过没有找到一个实例被拒的，所以我不太相信，我找到一个女生她是IGS1年之后再申请PSW并没有因此被拒，我也再三找了不同的律师询问，特别是找到下面一条，就好象李贞驹描述的一样，我们这种在leave to remain他们应该会再给1年作为a period of difference)，总之我6月会面签，成否都会上来说一声。
上次johhn跟我说好好读读那些条款，确实有帮助.
(a) Leave to remain will be granted:
(i) for a period of the difference between 2 years and the period of the last grant of entry clearance, leave to enter or remain , to an applicant who has or was last granted leave as a Participant in the Fresh Talent: Working in Scotland Scheme, as a Participant in the International Graduates Scheme (or its predecessor the Science and Engineering Graduates Scheme). If this calculation results in no grant of leave then leave to remain is to be refused;

因为有些条款之间是并列选择关系，有些则是各自都要满足，隔壁也有人问相同问题，但多数说超过transitional period就不行，反正fresh talent是明确说两年没用满可以补个时间差，但前提是持有bno护照，而segs却没有提这茬，还是明确问问ho的好，以免浪费钱。good luck

If you were last given less than two years’ leave under the International Graduates Scheme or Science and Engineering Graduates Scheme, you will be able to apply to the post-study worker category under the transitional arrangements. The arrangements allow you to get a total of up to two years’ leave under a combination of your previous scheme and post-study worker.
我的理解是 因为后来是学习后给2年了 所以 如果你之前给的是1年 那么还有1年…
但是苏格兰的 fresh talent 因为本身就是2年 所以就不能给psw了

恩，我看过了，你说的bno是在245FD. Requirements for leave to remain的条款里：
(g) An applicant who has, or was last granted leave as a Participant in the Fresh Talent: Working in Scotland Scheme must be a British National (Overseas), British overseas territories citizen, British Overseas citizen, British protected person or a British subject as defined in the British Nationality Act 1981.
bno下面的245FE. Period and conditions of grant就是我说的这段，其中有fresh talent, IGS, SEGS都会给a period of the difference, 这些条款通篇看下来是说若是entry clearance，那这个difference是不给的，但是leave to remain就可以补一个差；我之所以不断地找一些线索，开始也是因为李贞驹说的很确凿，我们这种情形可以再拿到1年，完全没有问题，我当时还问她以前有遇过吗? 她说有，都拿到一年了，让我放心之类，只要其他材料准备全了就行了。

根据我读的理解，若申请人之前申请过 IGS，但是人在国内要申请PSW的entry clearance是不可以的，但是若是leave to remain就可以给1年。
我知道entry clearance是不可以的，但似乎见到问这个问题的人都是中间有过其他甚至若干签证，wp，t4，dependent之类的，还有的曾经有过签证空白期（当然人在国内，没有overstay神马的），所以我只是好奇ls这位是否也是。
我也特希望有亲身经验的人能多谈谈，对后面的人很有帮助。。。。

This change came into effect on 31 March 2009.
