以前老的法规2012年12前,T1(G)申请永居,带薪年假离开英国不算absence的。
现在在新法规下,带薪年假算absence吗?
T2(G)写明了带薪年假不算absence,但T1(G)没写,这样子,T1(G)的带薪年假算absence吗?
有没有人有实际申请经验的(2012年12月13日后T1(G)申请永居的)
很奇怪,关于absenceg天数的计算,为什么T1(G)和T2(G)要分成2个不同大类来写,但是我看理由都是一样的:
T2(G)的写法:
Absences must be for a reason that is consistent with the original purpose of entry to the UK or for a serious or compelling compassionate reason
T1(G)的写法:
absences must be for reasons connected with the applicant’s purpose for being in the UK or for serious or compelling compassionate reasons.
另外,法规上没有写一次离境不能超过90天,只是在申请表上要你勾选你是否有一次离境90天的,
那么,是否一次离境真的不能超过90天呢?
在UKBA的网站上的这个写法,没有上下文的情况下,很容易误导的:
原文的说法是:你不能离开UK超过180天,而且 你的离境是跟你的T1(G)签证相关的。
但是在如何计算5年合法居住的细则里,却是在描述什么情况下不算absence的section里说的下面这句话Absences which will not break continuity in the continuous period。所以,没有上下文的理解,很容易就会产生令人误解的解读!
UKBA这样只是偷懒式地摘抄了一句话,是不严谨的。(不过,相对于天朝的一些条例,我觉得UKBA的条例总体来说真的比较不错,它的严谨及条理化是我留学英国的一个最大收获之一。英国才真是一个法治国家,天朝都是吹的)

During the continuous residence period, you cannot be outside the UK for more than 180 days in any 12 consecutive months. The absences must be for a reason that relates to the purpose of your leave in the UK, or for a serious compelling reason (such as a serious illness). Your sponsor must confirm the reason for the absence if it was related to your work. You must confirm the reason if it was for a serious or compelling reason.
