T2续签被拒，大过年的真是堵心，请各位帮忙看看呗~

请问被拒之后，有没有确切的离境时间限制？从哪天开始计算？
官网上有规定吗？

我原有签证1月14号到期，今天才收到拒信，下周一就超过28天了。如果我下周一之前回不去国内，是不是回国也没法重新申请？因为overstaying了？
护照材料都还没给我邮寄回来，如果我不申诉，直接回国了，需要给HO写信告知吗？

签证被拒了，有两个原因：

1.因为没有满足最低每小时工资要求。
your prospective salary is not at or obove the minimum rate as specified in the Codes of Practice

2.英语成绩单不在要求列表里。
The test you have provided is not included on the published list of English language tests that have been assessed as meeting the requirements for the award of 10 points.

先说第2条，我参加的是 BULATS Online的考试，当时就是从UKBA的列表里选择的啊，怎么又说我的考试不在列表里呢？
接到拒信，又确认了一遍，明明在的啊：

至于第1条，只能怪自己不认真，当时没有仔细查条款，也没弄清楚年薪和要求的时薪的计算方式。
不过年初我刚涨工资了，现在的工资已经达到标准了。

求助各位：
1.我这种情况是不是没法上诉? 只能重新申请？现在涨了工资了就可以了吧？
不上诉的话，我怎么知道我的英文考试成绩到底合格不啊？有没有人也参加过BULATS Online的考试啊？

2.因为原来的签证已经过期了，信上说让最迟3月2日离境。
在这之前我重新申请签证的话，到新的结果出来前，是不是就仍然是合法居留？

3.我提交的材料什么时候会给我邮回来？需要自己联系他们要回来吗？

也许不同类型的要求不同吧，反正我那个类别需要提供英语水平证明。

我是Tier 2 General 的，也准备续签了，我把Guidance看了一遍，需要Life in the UK的证书，由于是续签，所以不再需要提供其它英语证书也可以获得10分了呀。

楼主是续签T2的话是不需要提供英语能力证明的，这个10分是自动获得。

You will meet the English language requirement automatically and score points without having to send further evidence if:

you have previously been given permission to stay under Tier 1 (General) or Tier 1 (Entrepreneur), or as a businessperson, a work permit holder, a representative of an overseas newspaper, news agency or broadcasting organisation, a member of the operational ground staff of an overseas-owned airline, or a Jewish agency employee;
you were given permission to stay under the Highly Skilled Migrant Programme after 7 November 2006;
you were given permission to stay in the past under Tier 2, have already given us evidence that you meet the Tier 2 English language requirement, and are applying to extend your stay;
you are applying because you have changed jobs, and you have already given us evidence that you meet the Tier 2 English language requirement; or
you are applying because you have changed jobs, and you have been given permission to stay in the past as a minister of religion on or after 23 August 2004.

所以你那条语言的问题甚是奇怪:cn17:

不过就算是语言哪一条UKAB犯了错，但是如果你当初提供的的收入不符合要求的话，那同样也是直接拒签。这一点其实你上了诉也没办法改变当初的决定。

You must score 10 points for your English language ability if you are applying to extend your permission to stay in the UK to more than 3 years in total. The English language page contains more information.

至于你的，我上面的回复不是贴出了UKBA的原文了嘛，如果是extend T2 那么因为你在以前第一次申请T2的时候已经递交了语言能力证明所以是不需要提供个（那段红色的话）

第一次申请T2那么就一定要有语言能力证明，除非申请人是英语语言国家的公民。

谢谢，您说的这条我再仔细看看。记得当时也看到这条了，但最后结合我的情况发现好像还是不行，具体是因为什么我记不清了，我再捋一遍。

因为当时快递签才发现需要考试，时间紧，咨询之后发现只有BULATS Online的考试能在我递签之前出成绩单。没想到还不被承认。
真不知道这条是不是签证官眼花了漏看了。

就UKBA的官方介绍来看你考得那个，是要在一定条件下考到的（必须是Certificated BULATS）才被视为可以接受的语言能力证明。

In order to be eligible for the BULATS certificate, the candidate must take the test through a Certifying BULATS Agent and must achieve a result (A1-C2) in each of the four skills: Reading, Listening, Speaking and Writing for Online BULATS. All skills must be taken on the same day. It is not possible to retake any part of the test on the same day. The BULATS certificate will be issued at the lowest CEFR level achieved over the four skills. Please note that candidates who score below A1 overall will not be issued with a certificate.

Certifying BULATS Agents

Please note that not all BULATS Agents offer Certificated BULATS. Candidates wishing to sit a BULATS Online test to get a certificate for the purpose of a UKBA visa application will need to

contact a Certifying BULATS Agent
tell the Agent in advance that they want to take a Certificated BULATS test.
The Agent will then make the necessary arrangements.

NB: BULATS certificates cannot be awarded retrospectively.

所以会不会是当初你考试时使用的那个BULATS Agent并不符合要求，所以即使你考了，你的证书也不符合要求。

退一万步讲，不考虑语言这个因素，你在申请时提供的收入水平不符合要求，同样也是直接拒签。所以，怎么样都会是同一个结果。

谢谢。我1月份刚涨了工资，现在的工资能达到要求了。所以我想重新申请一次。

但是得先搞明白英语成绩那个，要不怕重新申请还是会被拒。

哦，我又看了一遍申请表，之前看错了，原来表上说的是：Tier1和Tier2 的holder在申请ILR的时候需要出具life in the UK的证书。

我的理解，它是不是说：已经获得了T2签证，并且提供过英语水平证明，现在想续签。是不是这三点都要满足才行？
我第一次签T2，没提供过语言证明，是不是就不满足？

我的律师推荐我靠的Pearson Academic Test.周日考得，周一就出了结果。直接通过他们网上发过去就好了。

语言成绩的话，你可以看看我上面的回复的，和所给出的连接，联系一下 BULATS 查一下你所考试的那个Agent是否符合规定。我觉得问题是出在这里。

至于重新申请，从去年10月开始，如果实在签证到期28天以后递交的申请一律直接拒签，这个和UKAB告诉你离境的日子没有关系。所以，你是否可以重新申请就要看你的上一个T2是什么时候到期的。比如：31/01/13是上一个签证的最后有效的那一天，那么在3月1号之前（不含3月1日）递交申请UKAB还是会考虑审批的。3月1号开始递交的就没戏了。

是按照上一次签证的日期算啊。那看来我不能重新申请了，下周一就过期了，但是现在刚收到拒信，护照材料还没有还给我呢。

那请问我这种情况，可以回国后再续签吗？
