求助如何定义permanent 合同和 fixed term 合同（更新probationary wording)

最近收到一个offer, 说好是permanent position, email里人家director 也confirm是permanent position. 拿到合同是这样写的，

The extent of the contract will go from xxth May 2013 to xxth May 2014, to one month period
previous to the expiration of the contract any of both should give notice in writing for its
termination. After this period the contract will be updated automatically if any of both parts agree
with the existing conditions within this contract.

There is a probationary period of 3 month starting from your date of commencement with one week
notice in writing on either part during this period.

红色的字也是在这个合同上的，这样一来能认为以上合同是permanent吗？？

回信询问，director说这个是permanent contract, 他们都是这样写的，我只好跟她说让她改下合同，改成下面的wordings…

Your employment is not for a fixed term and there is no anticipated duration for your employment
but it may be terminated by notice. After the successful completion of any probationary period, your
employment may be ended by either you or the Company giving the opposite party written notice
(refer to Clause No.xx - termination of employment for details).

在这里请教下，第一个版本我个人认为是个1year fixed term, 对吗？

还有个问题就是fixed term contract 和permanent contract的本质区别是神马？没有明确的结束日期就一定是permanent吗？

正式员工一般都有一个试用期。

一年的试用期也太长了吧？英国这边一般都是 3 或 是 6 个月吧。

刚google了一下，英国法律上没有试用期这个说法。进去了员工待遇都一样。{:5_129:}
lz这个合同说的第一年我我理解的是实质像是试用期，后面有说第一年之后自动续。
只是第一年双方都可以提前一个月通知走人。
我理解这个合同算是permanent的

第一个版本应该就是permanent的但有一年的probation（试用期），一年试用期非常普遍的但第一个版本过分强调这个一年了。

很多工作都有probation的，根据exprience的情况probation可长可短，有一年的也有三年的（比如刚刚拿PhD就做大学老师的probation大部分是3年的），probation结束的时候有一个review（assessment），如果不通过的话probation会延长。

饿，我也刚刚拿到一个offer，上面也是写着fixed term，但是hr和我说是permanent的。
自己也觉得怪怪的，尤其上面说如果一年以后双方没有新的agreement，可以不用notice 就双方自动解除合约。自己也很迷茫。同问哈。

这个我知道在英国貌似是4年的fixed term,续签两次后可以转成p的。

不是probation, probation 后面明确写了是三个月，所以不懂这个是不是fixed term.

龙哥，我第一个版本的合同的在上面那段关于一年的文字后面写着是三个月的使用期，也就是说试用期被明确为三个月了，这样一来第一个版本还是permanent吗？

额 好诡异啊 幸好我们这里很傻的就直接写permanent full-time basis balaa…也没有probation

fixed term的话公司没有obligation去renew你的contract而且你可能不会享受到一些permanent员工才有的福利probation period里面一般notice period比较短而且公司可以比较容易炒掉你`过了probation period公司就非常非常难炒掉你~~

英格兰用open ended 表示permanent.

职位可以说是Permanent的，合同的性质也可以说是Permanent的，只是有个约定提前通知可终止的条件而已。本质上和Contractor的合同还是有区别的，Contractor的合同到期自动终止的，不需要提前通知。
