We write to inform you of new legislation that has come into force with effect from 1st October 2015 namely, The Smoke and Carbon Monoxide Alarm Regulations 2015.
This will make Landlords in the private sector in England responsible for ensuring that smoke and carbon monoxide detectors are appropriately installed & that they are in proper working order at the start of a new Tenancy. In brief, Landlords will have to ensure as from the 1st October 2015 that a smoke alarm is fitted on every floor of their property where there is a room used wholly or partly as living accommodation, under the proposal a bathroom or lavatory is classed as living accommodation and legislation also covers halls, landings and stairways. For instance, for maisonettes of flats above a shops where the flat is on the first floor but enter via stairs on the ground floor as smoke alarm needs to be fitted in the stairwell.
Also Landlords will have to ensure that a carbon monoxide alarm is fitted in any room where a solid fuel is burnt.
At the start of a new Tenancy Landlords will be required to demonstrate that the alarms are working & therefore it is advisable that the Tenant/s should sign to confirm. It is then the Tenant(s) responsibility to ensure the alarms continue to work throughout the Tenancy changing batteries where necessary. A faulty alarm will be the responsibility of the Landlord to replace.
The legislation will be enforced by the local council & failure to comply can result in fines up to £5000.
