苏格兰买房交换合同前能中止交易吗?新人求助!

这里是弱弱的新人一枚……
学生党,没有贷款。第一次买。

3月看了很多房子,最后选了1个(一室一厅的)flat,说实话户型不是特别满意,厨房很小,卧室也不大,而且是ground floor。但当时实在是太累了,觉得一时也找不到更好的房子了,又想夏天之前入住,跟家里商量之后就给了OFFER。当时是除我之外还有一个人有兴趣,我通过竞价拿到了。目前是刚拿到正式的acceptation,但还没返回给卖方。其实这个房子买了之后装修也有点头疼,因为空间不大,可能需要我再打吊柜啊什么的……

结果前几天又看到了1个flat,虽然也是一室一厅但是厨房很大可以直接做餐厅用,客厅、卧室也比之前那个大,储物空间多,户型图看的非常满意,朝向、位置相对来说都差不多,楼层是first floor(我认为最好的楼层),价格按home report比上一个房子贵不了多少. 水电煤气窗户什么的也都没问题,于是就十分心动……

目前律师去度复活节假了- -b 犹豫了几天今天还是跟中介约了明天去看房子……因为实在很心动……
现在就是想问问,这种阶段,之前那个房子的交易我可以中止吗?会有什么不好的影响吗?

PS,前边的交易我什么都还没提交,什么费用也都没交,这边也没有押金一说。但是我看网上是说,苏格兰这边买家是不能随意退出交易的?实际情况到底如何呢?希望有经验的前辈解惑!!十分感谢T-T

missives签了没?签了就不能反悔,没签就随便

:shutup:估计悬,你仔细看你和律师之间的邮件,你给个offer当对方接受的时候,律师会和你确认这有法律效益啥的,具体到了那一步以你的邮件为准

只要你们还没exchange contract, 随时可以毁约,上周我就撤了我的offer。

苏格兰不可以的。只要你出offer,然后offer accepted之后就不能反悔了。

你律师和对方出过missive嘛? 如果出过已经具有法律效力,不能反悔

如果3月出的offer 应该这个missive已经交换了,楼主,律师通常会给你邮件,邮件里面会说这个已经具有法律效力,如果没有到这步,就反悔吧

我还没回复。这不算合同吧?算missive吗?

是三月下旬给的offer 目前刚到qualitied acceptance

我的律师说,offer被接受后,买家卖家双方就都不能反悔了,因为苏格兰offer是律师给出的,已经具有法律效益了。所以苏格兰买房子根本不交押金的,都是最后交钥匙那一天或前一天,所有资金包括律师费转给律师,等拿钥匙就完成了。
你直接问你律师吧。

第二套房子尽管去看,第一套赶紧问律师。不要第二套没拿到,第一套也没了。

I want to withdraw my offer

It is legally possible to withdraw your offer at any point until missives are concluded. To be safe, it is best to get your solicitor to formally withdraw your offer in writing and send this to the seller’s solicitor urgently. However, in practice, it is not a good idea to withdraw your offer lightly. The important thing to bear in mind is that you shouldn’t submit an offer unless you’re really serious about buying a property and you know for sure that you can afford it and will be able to get a mortgage if necessary.

If you want to withdraw after missives have been concluded, the seller can take you to court as you will be in breach of contract. This could potentially cost you a lot of money and you may also have to pay the sellers’ expenses (this might include paying high interest rates on bridging loans for example). However, if it is impossible for you to do this (for example, because you don’t have the money), the seller may ask you to compensate them for the costs of finding another buyer instead. Speak to your solicitor immediately if you’re in this position.

最好还是问律师

律师有没有跟你提过binding的事? 如果没有binding应该是OK的,但是你的律师会很不高兴的,而且似乎他不可以继续做你的律师了。

那你的意见就没有参考价值了。苏格兰和英格兰房屋买卖法律条文不一样的。

苏格兰。底层flat。。。我现在就租在底层,如果可以反悔一定不要接这个房子啊。。因为底楼又冷又湿。最好2-3楼
