两年租期结束后租客拒绝搬出而且在屋外堆放大量垃圾怎么办

两年租期今天结束,很客气的问租客交回钥匙并清理屋外的垃圾,她不肯搬,让我们去走驱逐程序。去年已经被忍无可忍的街坊邻居投诉她堆放外面很久的破家具,帮她丢过一次垃圾斗,没过多久又丢一大堆在门前停车位,特别影响邻里关系。她最近带来两只猫,没有事先通知我们(合同规定不能养宠物,不能在屋里抽烟,她天天抽烟)。最初的租房合同是跟她和老公两个人的名字,老公有稳定工作,疫情期间全职上班,她带三个小孩,不同的爹。因为老公赌博他俩人打架闹得警察来,把老公赶出去了。现在大的小孩去上大学,最小的才上小学。不想跟她续约,两年已经被她折磨够了。也不想花钱上法庭,因为费用不可能执行。她在回信中是这样写的:

I’m very sorry that there has been no communication from both parties regarding the end of the tenancy. My understanding is that when a fixed term tenancy reaches an end these are the options.

Your 3 options at the end of a fixed term are:

sign a renewal agreement for a new fixed term

let it become a rolling or periodic tenancy

leave the tenancy

As neither party expressed a wish to vacate the property (please see 8.4 of the tenancy agreement.) it becomes a rolling tenancy. Therefore unless you follow the legal eviction process I am not in a position to be able to move out at the moment.

With regards to the sofa, no complaints were made to me and you offered to put it in the skip. I was in the process of trying to raise the necessary funds to have it removed as you were aware of the situation that I was in of ending a domestic violence relationship. My main concerns at the time were to ensure that rent, bills and food was provided. I will also be arranging for the rubbish that is currently on the driveway to be removed in the next few weeks as I am now unable to do so myself due to my declining health.

I am very sorry that we find ourselves in this situation but I have not been given correct notice to move out and do not have the funds to be able to find somewhere new to move to at the moment. I hope we can come to an amicable solution.

不管房客有无过错,你不续约也要serve notice, 否则就是默认rolling contract.
现在你马上serve notice吧。 别和人家动气了把人家惹恼了马上拒付房租你也没法子。你来硬的就变成你无理了。现在房东是弱的一方没得人护的。

我们上次请房客走是好几年前了,那个时候也不用给理由,只要时间给够就可以。近两年法律变了,你得有正当理由才能请人走。而且现在covid, 对房客更是有保护。 我们当时是交给中介办,出了那么多管理费也就那一次替我们省了事。
